TheArtGuide.com, LLC (also defined as, The Art Guide, TAG, Art Guide, We, Our, www.TheArtGuide.com, TheArtGuide.com and the Site) is committed to protecting the personal information provided by its Clients’(also defined as, Members, Users, Visitors, Artist Feature and Gallery Feature) while visiting this website specified as, www.theartguide.com. We respect Our Clients’ privacy and are committed to protecting information they submit to Art Guide Gallery and Artist Accounts.

Use of this Site during and after any client post including text and images, submitted for public viewing complies with the Client’s agreement and acknowledgement of herein noted Policy, Terms, Agreement, conditions and changes. Please be certain to read all following statements that directly or indirectly affect Client Terms of Use and Responsible Use Policy for TAG and associated third-party interaction with this site.

TheArtGuide.com is a Trademarked website designed to support, promote and encourage the growth of art through the spirit of creativity in any art community or art organization throughout the United States and internationally. We welcome the interaction and opportunity to share Client provided art information through text and images, of art events, exhibitions and calls for art/artists at no cost to our viewers and those who post announcement information.

It is understood that, TheArtGuide.com uses open-source images that are free reusable visual assets licensed under open terms, such as public domain dedications that permit use for commercial advertisements without requirement of paid royalties; as well as images submitted or uploaded by this site’s Members. Per the terms of this Policy, our sources and Art Guide Clients allow and fully authorize shared image use, modify, and distribution; for marketing or advertising purposes and campaigns. Please contact the Art Guide administration at admin@theartguide.com, if a found Site image does not meet with Client authorized permission, as defined by policy or open-source reusable compliance.

Additionally, TheArtGuide.com does not now nor will it openly promote personal interests, group programs, religious or political organizations, ideologies or any agenda that include social causes with the intention to endorse specific individuals or a segment of society.

2.  TheArtGuide.com LLC, Use of Website Images and Text Disclaimer

The Art Guide will only share personal account information with third parties that help us perform the actions described in this Privacy Policy, Agreement and Terms of Use as for general public promotions or advertising. All artwork, images, and text displayed at The Art Guide website are the exclusive property of its individual Artists/Gallery Clients, Member art owners or Museums; that has been provided to Art Guide through their authorized consent and agreement to this Policy; and as submitted for Our use with intended collaboration in promoting works of art or events via planned Feature Listings, Exhibitions, Events, Calls for Art, social media and mass emails. Unauthorized use, reproduction, download, or distribution of any TAG content without prior written permission of the individual owner, museum, Artist or Gallery Client, as a result of using this website is strictly prohibited.

Artworks shown are representative of current down loaded collections by Art Guide Clients; exact colors may vary slightly depending on individual electronic device or screen settings and are not the responsibility of Art Guide or its independent website developer entities.

 

3.  Practices and Collection of Client Information

The Art Guide registration and process for posting Feature Gallery/Artist Listings, mass emails, Banner Ads, Exhibitions, Events and Calls for Art; require the necessary collection of data for Site entry information as provided voluntarily by the User and include such information as; basic descriptive text, images, address, website, email, phone number, name and title.

3.a)  Collection of Data for Posting an Art Guide Listing: By choosing to become an Artist or Gallery Member, Client, Featured Artist or Featured Gallery of Art Guide; you fully agree to and authorize the use of your submitted Client information and in so doing agree to all terms of this Policy including Agreements. Client submitted information to Art Guide is of the Member’s own recognizance and accord for the purpose of promoting a dedicated URL Art Guide website page announcement and other promotional advertising. An individual Client who chooses to submit entry information for approval as an Artist or Gallery Member; understands that the submission will be vetted for appropriate content, and if approved by Art Guide administration, is accepted as by Client’s intended design and then assigned an unique URL TAG web page announcement.

3.b)  Post of Featured Artist or Gallery Submission: Due to the cost of TAG administrative processing and technical handling incurred by posting a listing to The Art Guide for Artist, Gallery social media, Feature, mass email or banner ad; members will not be offered a financial reimbursement or in-kind return once a submission is approved and launch to a dedicated Art Guide website page URL.

 

4.  Third Party Interaction and Sale of Client Artwork

The Art Guide cannot now nor in future be held responsible for the sales, rental, media distribution, promotion, advertising and any form of interactive material distribution of its site content; between Clients or site Users with third-party individuals and entities. This includes all related TAG page content about its Client and their works, as in use for enrichment with regard to third-party practices. All emails, art sales and communicated exchange of any type or nature as a result of posting a listing, announcement, social media, mass email or Featured position with The Art Guide, LLC; for arrangement of art sale or artist enrichment are solely the responsibility of the above-mentioned TAG Client and their third-party entity.  The Art Guide staff, its principal, Our associated entities and web site developer/programmers; do not involve, take part in, benefit or profit from its Clients’ sales and associated actions. Nor does Art Guide and its above defined entities, claim responsibility for any aspect of art sales including any enrichment, that may result from information posted at this website; concerning communication, contact, cooperation, sale or interactions of electronic distributions, published hardcopy distributions, sale of art or purchase of Client art/text as a result of Art Guide’s posted website information. As defined, Art Guide administration is not involved in the sale of its Client’s art and we do not receive financial or in-kind recompence for posts to this site upon the sale of art.

 

5.  Client Information Submission, Administrative Vetting

Art Guide Users applying for and potentially accepted to the position of Client Artist or Gallery require a vetted review by TAG administration to confirm appropriate entry information and final acceptance as a Client. TAG administration is not required or under an authority to accept any individual or group submitted application/entry. All Client provided information is understood by Art Guide administration to be of full veracity and relevance for use in posting to a dedicated URL page announcement. The submitted site information is hereby agreed to and authorized by the Client for promotion and electronic distribution through Our administration and with third-party organizations or entities, for the purpose of promoting artist, museum or gallery works, text descriptions and images.

5a.)  The Art Guide, may use basic Client authorized entry information including images for the purpose of mass emails, social media, advertising and exchange with a variety of potential Users, for promotions with third-party entities. Likewise, The Art Guide Principal holds true the discretion and responsibility to terminate thereby deactivate; a User account and its active entry data, as based on administrative review of; inaccurate information, possible illegal submission, possible copyright infringement, possible inappropriate images or text information submitted by a Client; as those actions are considered in violation of TAG Policy, Terms and Agreements.

5.b)  The Art Guide is unrestricted in review of Client submissions and at any time can remove website posted information by an Artist and Gallery listing of; Exhibition, Event, Call for Art/Artists without cause, prior notification or correspondence. The Site administration holds its Client museums, artists, galleries and their associated works; both with Art Guide website and through any other third-party off-site organizations, to the highest ethical standard in distribution of Client electronic and physical presentation materials. Appropriate artwork and associated text include, basic factual entry descriptions/data, a clear visual overview, context and visual image(s) of art. Sexually explicit or ambiguous images, and material of any inappropriate images or text, is strictly prohibited from use at www.TheArtGuide.com. If such image(s) or text are left unrecognized, obscured or added after live post; upon TAG administration discovery, that client will be immediately removed and denied future account access including use of the Site. The use of unauthorized, copyright, illegal or inappropriate posted information of any form by a TAG User client is considered an action that is in violation of Responsible Use Policy that can result in TAG administration legal response.

 

6.  Targeted Electronic Information Store

The Art Guide, LLC does not directly employ, but can potentially use “cookies” and technical applications (app) to facilitate Users quality experience of the Site. A cookie is a small amount of data stored at the Client computer and recognized by a browser. Cookies allow for fast transfer of account information as well as search and examine internet traffic and development. The User can disable this function through their browsers, which could potentially limit easy access to The Art Guide web site.

 

7.  Web Site Security

The Art Guide, LLC and its programming agencies attempt to safeguard and maintain the website through the use of advanced cyber security programming provided through WordPress (WP) Engine, Inc. services. The TAG platform is designed and safe-guarded for protection against unauthorized access; however, it is understood that despite secured safety measures and storage methods all internet programming is susceptible to unwanted and unintentional intrusions. Information provided to TAG and all operations therein, are stored using servers powered by WordPress (WP) Engine, Inc. WP Engine can potentially reduce the slow or lagging digital Site data transfer through specialized products and tools for website information dissemination and growth.

The Art Guide uses log files based at Google platform internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses and all aforementioned programming devices can potentially be linked by Google or other off site administrative browsers for personally identifiable information, not associated with Art Guide programming or uses.

 

8.  Art Guide Responsible Use Policy

The Art Guide is not liable for the accuracy or revision of individual profiles and postings. It is the sole responsibility of each User and Feature Artist /Gallery Member to maintain current information appropriate for public viewing. All Members may review and modify their entries at any time from within their private TAG account. Users may termination their TAG account by sending an emailed request to, admin@TheArtGuide.com for deactivation, while also recognizing that financial reimbursements are not possible through the existing PayPal system. Once deactivated, the User account will be deleted from the TAG data files.

8.a)  The Art Guide Responsible Use is for that of all Users and Client Members who are given charge to provide information of veracity and fully appropriate account text and images. Submissions for Event, Exhibition, Call for Entry, Featured Artist and Featured Gallery will be reviewed and approved by a member of The Art Guide administration. All posted text and pictorial information will be evaluated for correct content and presentation prior to approval. It is at the sole discretion of The Art Guide administration to provide consent for every submitted entry.

8.b)  The Art Guide is unrestricted in review of Client submissions and at any time can remove website posted information of an Artist or Gallery listing, Exhibition, Event, Call for Art/Artists without cause, prior notification or correspondence. Appropriate artwork and associated text include, factual entry descriptions/data, a clear visual overview, context and visual image(s) of art. Sexually explicit or ambiguous images and material of any inappropriate images or text, is strictly prohibited from use at www.TheArtGuide.com. If such image(s) or text are left unrecognized, obscured or added after live post; upon TAG administration discovery, that client will be immediately removed and denied future account access including use of the Site.

8.c)    Client use of unauthorized, copyright, illegal or inappropriately posted information of images, text and material of any type or nature by a TAG User, is considered an action that is in violation of this Responsible Use Policy, will be removed from the site and can be address through legal action.

9.  Art Work and Data Submission Fair Use Terms of Agreement

It the agreement of approved registered TAG Client that The Art Guide, LLC can and potentially will use Client submitted entry information of images and text for website announcements, ad postings, presentations of gallery/artist Feature listings; for the purpose of Art Guide promotions, mass emails and social media content including all types of advertising both electronic and hardcopy.  The TAG Client also agrees that their submitted information is authorized and legally valid for use at www.TheArtGuide.com website; that it is approved by them or through their represented organization/entity for use as Art Guide website presentation information or for use by one of Our third-party services. The Client agrees to the use of said information as approved for Site presentations, announcements and promotionally advertised events; which can directly or indirectly affect User ongoing activities as related to their TAG Site interactions and third-party entities. The Art Guide administration holds true its Client’s authorization of use in all said entry submissions, and reserves discretion to terminate or deactivate a User’s entry including active data, based on the consideration of finding illegal, copyright discrepancy or inappropriate applied information by a Client, and as an action that is in violation of these terms of agreement.

The Art Guide reserves the right to assume that of said submission use, the approved Client has legally authorized applied content for Site submitted images of photos, paintings, sculptural or art in general, as in the use of; Feature Listings and basic Client postings; for the purpose of TAG home page images, associated TAG internet pages or third-party internet promotional services such as mass emails, Facebook or X social media.

To request the nonuse of, or prevent photos from being used for TAG promotional purposes, please contact The Art Guide by email at your earliest convenience, admin@theartguide.com, and we will accommodate your request.

10.  Authorization of Payments

The Art Guide accepts payment for promotion of Feature Artist, Featured Gallery, Social Media content, Home Page Art and Banner Ad promotions as well as general donations by Users who frequent the site. Currently, there are two options for payment which include the use of PayPal, a secured standard in merchant and financial exchange, as well as payment through PayPal credit card services. Payments directed to the TAG site are first approved by The Art Guide Principal and processed through official PayPal secured banking channels. Reimbursements are not provided due to the processing costs involved in posting an interactive TAG user web page.

 

11.  Copyright Compliance and Agreement to Art Guide Use

The Art Guide, www.theartguide.com, respects the creative work and intellectual property of others. In Client member postings of material including text or images submitted to TAG website, via entry submissions and emails for the purpose of advertising and promotions; the registered Client represents that they are in ownership of that property, intellectual or physical material, and ensured authorization of use to said material. If you believe that your work has been copied to TAG in a manner that constitutes copyright infringement, discrepancy or other intellectual property contravention, please notify TAG immediately, admin@theartguide.com, to have it removed. Art Guide wishes to maintain compliance with and remain in good standing of all Client provided information.

 

12.  Conditions of Use, Notices, and Revisions

If you choose to visit or register to, http://www.theartguide.com, your visit that may include a dispute is subject to this Notice, Agreements, Privacy Policy and Our Conditions of Use, including limitations of damages, resolution of disputes, and application of the law of the state of Connecticut. If you have concern over privacy information posted to TAG, please contact us in an expeditious and direct manner, by emailing, admin@theartguide.com, in that we might take full measure to seek resolution. Our business changes constantly, and our Privacy Notice with Agreements and the Conditions of Use will change also. We may e-mail periodic reminders of our notices and conditions, however the client should regularly check The Art Guide Web site Privacy Policy page to seek recent updates or corrections. Unless stated otherwise, the current Privacy Policy Notice, Terms and Agreements apply to all information that the site contains concerning Client account submitted information.

 

13.  DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THIS SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED BY THE ART GUIDE, LLC, ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. TAG MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, ART SALES, ART ADVERTISING CONTENT, PRODUCTS OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE DISCRESION AND RISK.
